Fort Collins Boxing Fitness - Participant Waiver and Release of Liability
1. ASSUMPTION OF RISK & RELEASE OF LIABILITY By participating in any classes, training, events, or utilizing the facilities at Fort Collins Boxing Fitness ("FCBF"), you acknowledge the inherent risks involved in physical activity and voluntarily assume all such risks, including but not limited to injuries, illness, or death. These may arise from physical exertion, equipment, facilities, other participants, or unforeseen circumstances. You agree to release and hold harmless Meeks&Weeg Investments LLC DBA Fort Collins Boxing Fitness, its owners, officers, staff, contractors, volunteers, and affiliates ("Releasees") from all liability related to any injury or damage incurred on or off premises, whether caused by negligence or otherwise.
This waiver applies to all participants who are not entering into a full recurring membership agreement, including but not limited to individuals using a rookie pass, punch pass, two-week pass, free class pass, drop-in, or any trial-based access. All participants are subject to the same policies and expectations regardless of membership status.
2. HEALTH & MEDICAL CONDITIONS By attending FCBF, you affirm that you are physically capable of participating in physical activity and do not have any medical condition that would be aggravated by exercise. You agree to consult with a physician before beginning any new fitness program. FCBF is not responsible for any undisclosed medical conditions or injuries that occur.
3. PERSONAL RESPONSIBILITY & INDEMNITY You agree to be responsible for your own conduct and safety. You further agree to indemnify and hold harmless the Releasees from any liability, claims, damages, or expenses (including attorney fees) arising out of your participation, misuse of the facility, or actions that cause harm to yourself or others.
4. EQUIPMENT DISCLAIMER FCBF does not manufacture the equipment used in classes or training. Participants acknowledge and accept the risks associated with use of all equipment. FCBF is not liable for injuries resulting from defective or malfunctioning equipment.
5. CODE OF CONDUCT & SUBSTANCE POLICY Proper athletic attire and respectful conduct are required at all times. Participants must not attend classes or use FCBF facilities while under the influence of drugs or alcohol. Any participant whose behavior suggests impairment or intoxication may be asked to leave and may be barred from future participation.
6. MINORS Minors must be at least 14 years old to participate in classes. All minors under 18 must have a parent or legal guardian sign this waiver on their behalf in person or electronically. The parent or legal guardian assumes full responsibility for the minor's conduct, safety, and adherence to gym rules. Minors younger than 14 are permitted to remain in the designated waiting area during class times but are not allowed on the workout floor unless under direct supervision by a parent or guardian.
7. PROPERTY LOSS & DAMAGE FCBF is not responsible for the loss, theft, or damage of personal property. Participants are encouraged to leave valuables at home and use lockers at their own risk.
8. MEDIA & IMAGE RELEASE By entering FCBF, you consent to photography or video recording that may be used for promotional or social media purposes. You waive the right to any compensation for the use of your likeness.
9. GOVERNING LAW & LEGAL AGREEMENT This waiver shall be governed by the laws of the State of Colorado. Any disputes shall be resolved in the jurisdiction where FCBF operates. In the event of disputes not involving bodily injury, both parties agree to seek resolution through informal discussion, followed by mediation, and if necessary, binding arbitration under the rules of the American Arbitration Association.
10. ELECTRONIC SIGNATURE CONSENT By electronically agreeing to this waiver, you acknowledge that it is legally binding and has the same force and effect as a handwritten signature.
All passes and class credits are non-refundable unless otherwise required by state law.
